Echoeback LLC – Terms & Conditions

1. Background

Echoeback empowers you to create digital time capsules—text or video messages—to be delivered to your future self (or to friends) at a date you choose. All features and updates to Echoeback are subject to these Terms.

2. Definitions

• Account Your registered profile on Echoeback.

• Capsule A scheduled text or video message (“Digital Capsule”).

• Content Anything you submit: text, video, images, etc.

• Free Plan One complimentary Digital Capsule (one‑time use) with delivery scheduled between 1 and 6 months from the creation date.

• Paid Plan Purchase individual capsules ($5–$10 each) or subscribe for unlimited Digital Capsules, extended delivery options, and extra features.

• Supporter A user who makes a voluntary donation (“Buy us a coffee” tiers), earning a “Supporter” badge and thank‑you perks—donations do not include additional capsule credits.

3. Accounts & Registration

3.1. To use Echoeback, you must register with a valid email and password (or social login).
3.2. You agree to provide accurate information and to keep your credentials secure.

4. Creating & Delivering Capsules

4.1. Digital Capsules:

• Choose text or upload video, schedule a delivery date (within plan limits), and submit.

• Free users: one capsule only, 1–6 months delivery.

• Paid users: unlimited capsules, plus extended delivery dates.
  4.2. Once scheduled, your Capsule is stored securely until its delivery date.

5. Fees, Payments & Donations

5.1. Free Plan: One Digital Capsule (1–6 months); thereafter, purchase or subscribe.
5.2. Paid Plan Options:

• Per‑Capsule Purchase: $5–$10 per Digital Capsule or “Send a Friend” message.

• Subscriptions: Tiered monthly plans unlock unlimited capsules, extended delivery, and early‑access features.
  5.3. Supporter Donations: Voluntary contributions ($5, $10, $25, $50, $100) earn recognition and minor perks (e‑letter, merch opportunities) but no capsule credits.
  5.4. All payments are processed via Stripe; by purchasing, you authorize charges to your payment method. All sales are final, except where prohibited by law.

6. License & Sharing

6.1. You retain ownership of your Content. By submitting a Capsule, you grant Echoeback LLC a perpetual, royalty‑free license to:

• Store and deliver your Capsule as part of the Service.

• Publish it on a private, anonymous gallery for Echoeback users.

• Share excerpts or testimonials on Echoeback’s social channels, with personal identifiers redacted unless you opt in.

7. Content Standards & Conduct

7.1. You warrant all Content is yours or you have permission to share it.
7.2. Prohibited Content includes unlawful, defamatory, harassing, hateful, pornographic, infringing, or malicious (viruses, malware) material.
7.3. Echoeback may remove any Content that violates these Terms, without notice.

8. Privacy & Security

8.1. Our Privacy Policy details how we collect, use, and protect your data.
8.2. We employ reasonable security measures (encryption, access controls), but cannot guarantee total security. Transmission of data is at your own risk.

9. Intellectual Property

9.1. Your Content: Yours. Echoeback’s limited license (see §6) enables us to operate the Service.
9.2. Echoeback IP: All trademarks, designs, code, and branding belong to Echoeback LLC. You may not use them without permission.

10. Suspension & Termination

10.1. We may suspend or terminate your access for breach of these Terms or at our discretion.
10.2. Upon termination, unpaid periods cease immediately; paid subscriptions end at the close of the billing cycle—no pro‑rata refunds unless required by law.

11. Limitation of Liability

To the fullest extent permitted by law, Echoeback LLC is not liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability is limited to the amount you paid Echoeback in the 12 months before any claim.

12. Governing Law & Dispute Resolution

These Terms are governed by Delaware law. Any dispute will be resolved exclusively in the federal or state courts in New Castle County, Delaware.

13. Changes to Terms

We may update these Terms at any time; changes take effect when posted. Continued use of Echoeback constitutes acceptance of the new Terms.
